TERMS AND CONDITIONS FOR ONLINE ACCOMMODATION BOOKING SERVICE

1. FORMATION OF THE CONTRACT

1.1 One NorthEast Tourism Team ("ONE-TT") provides an accommodation booking service on this site. The accommodation you select will be booked for you by ONE-TT as agent for the accommodation establishment. These terms and conditions relate solely to the provision of the online accommodation booking service.
1.2 The contract for the provision of the accommodation is directly between you and the accommodation establishment on its terms and conditions, acceptance of which you confirm when you submit your booking form. ONE-TT is not a party to that contract. If there is any conflict between these terms and conditions and the accommodation establishment's terms and conditions, the accommodation establishment's terms and conditions will take priority.
1.3 You must be over 18 to make a booking, and by making a booking you are representing that you are of sufficient legal age and capacity to use our website and to create binding legal obligations for any liability you may incur as a result of such use.
1.4 Before submitting the booking form please ensure that the accommodation establishment you have selected and its facilities accurately matches your requirements.
1.5 An email acknowledging your booking will be sent to the email address you have provided. You will then receive a second email containing details of your booking. This is your confirmation form and your booking will be binding upon receipt of this. Please keep this confirmation form for your records as proof of booking and proof of payment.
1.6 Please check that all the details on the confirmation form meet with your requirements. If any of the information contained on the confirmation form is incorrect it is imperative that you let us know immediately by e-mailing ONE-TT at enquiries@visitnortheastengland.com.
1.7 If you need to make any changes to your booking you must contact the accommodation establishment directly as soon as possible, not ONE-TT.

2. PAYMENT

2.1 To the best of ONE-TT's knowledge, all prices quoted are inclusive of VAT and service.
2.2 The amount you are asked to pay to reserve the accommodation may be either:
2.2.1 full payment; or
2.2.2 a deposit of 10%, which is non-refundable. If only a 10% deposit is paid then the 90% balance must be paid on arrival at the accommodation establishment (unless the accommodation establishment's terms and conditions require you to pay the balance earlier).
2.3 Payment must be made by credit or debit card. You are required to provide details of your debit or credit card when submitting the booking form and by doing so you give authorisation for any sums due and payable by you in relation to the booking to be deducted from that card.
2.4 Your payment will be facilitated through a third party on behalf of the accommodation establishment and by submitting the booking form you consent to your details (including your credit or debit card details) being passed to them.

3. ARRIVAL

3.1 On arrival please:
3.1.1 produce your confirmation form to the accommodation establishment;
3.1.2 check that the accommodation matches the description of the accommodation establishment booked; and
3.1.3 if you only paid a deposit, pay the remainder of your balance (if you have not already done so).

4. CANCELLATION PROCEDURES

4.1 All cancellations must be communicated directly to the accommodation establishment as soon as possible, and will be dealt with in accordance with its terms and conditions.
4.2 Any cancellations by the accommodation establishment will be dealt with in accordance with its terms and conditions.

5. ACCOMMODATION

5.1 ONE-TT maintains descriptions of the accommodation on its website based on the information provided by the accommodation establishments. Such descriptions are designed as a guide only and are believed to be correct at the time of publication. ONE-TT will not be liable for any changes that may occur to the accommodation establishment.
5.2 Many accommodation establishments have specific facilities and cater for a wide range of visitor needs, such as disabled access, children, pets and dietary requirements. If specific facilities are required or if any member of your party has any special requirements, please contact the accommodation establishment directly prior to making a booking to ensure the requirements can be catered for.
5.3 In addition, some accommodation establishments will have specific rules and regulations that apply to guests staying in its accommodation. It is not possible to list all of these on this site and for further details you should check directly with the accommodation establishment before booking.
5.4 If on arrival, the accommodation establishment is displaying terms that are different to those agreed, the terms quoted at the time of booking will be honoured.

6. COMPLAINTS

6.1 If you have a complaint regarding the online accommodation booking system then please email enquiries@visitnortheastengland.com or write to Visitor Services, Tourism Team, One NorthEast, Stella House, Goldcrest Way, Newburn Riverside, Newcastle upon Tyne, NE15 8NY.

6.2 If you have a complaint regarding your accommodation then please inform the accommodation establishment immediately so that they can endeavour to put things right.
6.3 In the unlikely event that a complaint cannot be resolved you should contact one of the following inspectors, depending on the grading system for the accommodation:
6.3.1 for Quality Rosette write to Quality in Tourism, Farncombe House, Broadway, Worcestershire, WR12 7LJ, or there is a complaints form on their website www.qualityintourism.com; or
6.3.2 for AA, write to Caroline Walford, AA Hotel Services, 14th Floor, Fanum House, Basing View, Basingstoke, RG21 4EA.

7. LIMITATION OF LIABILITY

7.1 ONE-TT does not accept any liability for complaints, claims, loss or damage of any nature whatsoever arising from the provision of accommodation by the accommodation establishment.
7.2 ONE-TT will not be liable for any losses that you suffer as a result of any breach of our agreement relating to the online accommodation booking service except those losses which are a foreseeable consequence of the breach. In particular, since the services are provided to you as a consumer, we cannot accept responsibility for any losses related to any business of yours such as lost data, lost profits or other business loss that you may incur as a result of any breach of our agreement.
7.3 Nothing in these terms seeks to limit or exclude:
7.3.1 our liability if something we do causes death or personal injury through our negligence; or
7.3.2 certain terms relating to the supply of services that are implied by law.
7.4 You also have certain statutory rights under the Electronic Commerce (EC Directive) Regulations 2002 because we are advertising and selling services online. If we do not comply with these Regulations you have certain remedies. These terms and conditions do not affect your remedies under those Regulations.

8. DATA PROTECTION

8.1 Our Data Protection Policy sets out how any information you give to us will be stored and used.

9. GOVERNING LAW AND JURISDICTION

9.1 This contract will be governed by the English law and subject to the exclusive jurisdiction of the English courts.
9.2 The position outlined in clause 9.1 does not apply to consumers based within the European Union who are protected by EU legislation relating to governing law and jurisdiction (Council Regulation (EC) No 44/2001).
